Police Withdraw N400m Fraud Case Against Former Senator Andy Uba After Settlement

The Inspector-General of Police (IGP) has formally withdrawn the N400 million fraud charge filed against former Anambra South Senator, Andy Uba, following an amicable settlement between the parties involved.

Fraud Charge Origin and Allegations

Akahi News gathered that the charge, filed in 2022, accused Uba, his co-defendant Benjamin Etu, and one Hajiya Fatima (now at large) of conspiring to obtain N400 million from a businessman, George Uboh, under false pretence.

According to court documents, the trio allegedly claimed they could influence the appointment of the Managing Director of the Niger Delta Development Commission (NDDC) in exchange for the said sum — a representation the police described as fraudulent under Section 8, punishable by Section 1 (3) of the Advance Fee Fraud and Other Fraud Related Offences Act, 2006.

The Attorney-General of the Federation (AGF) had earlier granted the IGP permission on July 7 to prosecute the case. However, several attempts to arraign the defendants failed, prompting the court on September 24 to threaten an arrest warrant against Uba if he failed to appear at the next sitting.

Case Withdrawn After Refund and Settlement

At Thursday’s court session, IGP counsel, Aminu Abdullahi, informed the court that the police had filed a notice of discontinuance of the case, citing that the dispute had been resolved amicably.

“We filed and served a notice of discontinuance this morning,” Abdullahi told the court, adding that the defendants had refunded the N400 million to the nominal complainant.

Defence counsel, C.F. Odiniru, did not oppose the application for withdrawal, clearing the way for the presiding judge, Justice Mohammed Umar, to strike out the case.

Court Decision and Discharge

In his ruling, Justice Umar granted the police application, struck out the charges, and formally discharged the defendants.

This development effectively ends the long-drawn legal battle that had lingered for months over allegations of advance fee fraud involving the former lawmaker and his associate.
