Rivers Governor Fubara Risks Losing Six Months of Tenure, Says Kenneth Okonkwo

By Joseph Iyaji | Akahi News

A legal practitioner and prominent chieftain of the African Democratic Congress (ADC), Kenneth Okonkwo, has warned that Rivers State Governor, Siminalayi Fubara, could lose six months from his constitutionally guaranteed four-year tenure if he vacates office on May 29, 2027.

Constitutional Implications of Tenure Dates

According to reports, Okonkwo explained that the Nigerian Constitution pegs the tenure of elected officials at exactly four years, starting from the date they take the oath of office. If a governor assumes office after the standard May 29 handover date, any delay could potentially shorten the full tenure period.

Okonkwo emphasised that unless legal or constitutional amendments address such discrepancies, governors inaugurated later than the usual date may not serve a full four years before the next general elections.

Context and Concerns Raised

Observers noted that Governor Fubara was sworn in on May 29, 2023, following his electoral victory in Rivers State. However, Okonkwo’s remarks have reignited discussions about electoral timelines, tenure calculations, and potential reforms to ensure elected officials serve their full mandates without ambiguity.

Analysts believe this debate could extend beyond Rivers State, affecting other states where similar circumstances might arise.

Possible Legal Clarifications Ahead

Legal experts have called for clearer constitutional provisions to avoid recurring controversies over tenure length, especially with upcoming elections in 2027.

As the matter gains attention, stakeholders await possible interpretations from constitutional lawyers, lawmakers, or even the Supreme Court to prevent future political conflicts.

Akahi News learnt that this issue may likely feature in pre-2027 electoral discussions, given its potential political implications.
