Family of Late Moses Mba Sues Cross River Government, Demands N950 Million Over Alleged Killing by Security Aides

The family of 21-year-old Moses Mba, who was allegedly tortured and shot dead by aides attached to the governor’s residence in Calabar, has filed a legal suit demanding ₦950 million in compensation for what they described as an unlawful killing.
Akahi News gathered that the suit, numbered FHC/CA/FHR/79/2025, was filed at the Federal High Court in Calabar by O. R. Ogboaka, Okon Efut (SAN) & Associates, counsel to the Mba family. The case, according to court documents sighted by Akahi News, joins Victor Edet, Police Service Commission, Commissioner of Police, the Chief Security Officer to the Governor, and Governor Bassey Otu as respondents.
Family Demands Justice and Accountability
In the originating motion filed on October 10, 2025, the applicant, Mr. Stephen Mba (father of the deceased), argued that the assault, torture, and subsequent killing of his son were acts of executive recklessness, flagrant abuse of power, and gross violation of the deceased’s fundamental human rights.
The suit further demanded the sum of ₦950 million as exemplary and aggravated damages against the respondents. According to details obtained by Akahi News, the amount covers the unlawful torture, murder, and psychological trauma inflicted on the Mba family as a result of their son’s death.
“The applicant therefore seeks such other orders as the Honourable Court may deem fit in the circumstances,” part of the motion read.
Heartbreaking Account from the Deceased’s Mother
In an emotional account reported by Akahi News, Mrs. Victoria Mba, mother of the deceased, alleged that her son was brutally beaten and shot by security operatives attached to the governor’s residence on August 1, 2025. She explained that the young man succumbed to his injuries on August 9, 2025, while receiving treatment at the Naval Reference Hospital in Calabar.
Narrating her ordeal, she said:
“We were in Abia State when we received a call from a Red Cross official that our son had been rushed to the hospital. When we arrived, he told us he only requested to see the governor because he had a message for him from God.”
She added that her son was beaten, shot, and left in a pool of his own blood right in front of the governor’s residence.
Family Alleges Intimidation and Threats
Further revelations obtained by Akahi News show that the family has faced intimidation from individuals suspected to be government agents. Mrs. Mba alleged that these individuals have made attempts to silence her by offering bribes.
“They said all I need is money, that ₦3 million will keep me quiet. But Nigerians should please help me — I want justice for my son, who is still in the mortuary,” she cried.
She also recounted that a few days after depositing the corpse, the Commissioner of Police led a team to view the remains, but the family had already instructed the morgue not to release the body for any inspection pending the court’s direction.
State Government’s Response
Reacting to the tragic incident, the Cross River State Government condemned the act but denied the involvement of the governor’s current security aides. In a statement obtained by Akahi News, Erasmus Ekpang, the State Commissioner for Information, alleged that the young man was mentally unstable and that the residence he approached was the governor’s former home.
According to Ekpang:
“There is video evidence showing that the boy was throwing large stones at the policemen. He was not mentally stable and even apologised for his actions. Nevertheless, we condemn the beating and shooting — it is unacceptable.”
Police Await DPP’s Advice
Meanwhile, Commissioner of Police Rasheed Afegbua confirmed that the matter had been forwarded to the Director of Public Prosecutions (DPP) for legal advice. Speaking to journalists, he stated:
“Whatever advice the DPP gives, we will follow accordingly.”
Public Outcry for Justice
The case has sparked widespread outrage across Cross River State, with human rights advocates, community leaders, and civil society groups calling for transparency and accountability. Akahi News learnt that several residents of Calabar have taken to social media to demand justice for the slain youth, describing his death as “a tragic consequence of unchecked abuse of power.”
Observers say the lawsuit could become a litmus test for the judicial system in ensuring that victims of alleged extrajudicial killings receive justice, irrespective of those involved.
